Delhi Police drops charges against 5-year-old booked in rape case that shocked nation

The Delhi Police dropped charges of rape against a five-year-old boy who was booked last year after a girl of the same age was allegedly sexually assaulted in a reputed school in the capital city’s Dwarka area.
The case, from November last year, had grabbed national headlines due to the ages of the two children involved. The girl’s mother claimed the boy used his finger and a sharpened pencil to sexually assault her daughter in school.
The mother also accused the school’s management of not taking the matter seriously and not acting on her complaint. She approached Delhi Police which charged the boy under the stringent Protection of Children from Sexual Offences (POCSO) Act.
Nothing is an offence which is done by a child under seven years of age.

Cops, however, were flummoxed due to the boy’s extremely young age and decided to seek legal help in order to determine how to proceed in the case.
Now, the Delhi Police has decided to drop the charges against the boy since the Indian Penal Code’s Section 82 states that no act committed by a child under the age of seven can be considered as an offence.
Police have instead booked the principal and coordinator of the school as well as a class techer from the instruction. The vice chairman of the school too has been booked by Delhi Police.
